It is in clear violation of copyright, and all the user agreements. Jesse Schell (the lead developer of TTO) says, "The reason I can't help out with TTR is because, TTR is basically an illegal enterprise. HOWEVER, it does n0t automatically exempt TTR from copyright infringement. So basically, yes, the fact that the TTR team is not profiting from the game makes it more likely to be a legal fair use of copyrighted material. This does not mean, however, that all nonprofit education and noncommercial uses are fair." According to the same article on fair use, "Courts look at how the party claiming fair use is using the copyrighted work, and are more likely to find that nonprofit educational and noncommercial uses are fair. I also said earlier if TTR is deemed as fair use, then TTR would be completely legal, so there is a chance for TTR.
As I said earlier, TTR looks like copyright infringement, since it is almost an exact replica of original TT.
